Confirmation and deposit

It is understood that all orders confirmed by a deposit will receive priority. This deposit is not refundable if you cancel. If the client must change the date of his international removal, the changes will be made whenever possible.

Exceptions to liability

The carrier is not liable for :

  1. Loss, damage or delay due to “acts of God” or force majeure, enemies of the Crown, public enemies, riots, strikes, a defect or latent defect of goods, acts or mistakes made by the shipper, owner or recipient, authority of law or quarantine;
  2. The damage to the mechanics, electronic or other radios, phonographs, clocks, appliances, musical instruments or other material, regardless of the packer or articles that who packaged, unless the carrier has made preparation and development of these devices;
  3. Damage suffered by the works of art, glass and mirrors framed or unsupported, and this, whatever the nature of such damage;
  4. Deterioration or damage to perishable food, plants or pets;
  5. The loss of items packed by the customer, unless the vessels are open for inspection of the carrier, the articles are listed on the bill of lading and the carrier acknowledges receipt;
  6. The damage claimed for an entire group of items if only a portion of the items is damaged or lost. In this case, the carrier's liability is limited to repair or retrieve all parts that were lost or damaged;
  7. Of any damage to items on the site of delivery, if the client was not present to acknowledge receipt of such items upon their arrival;
  8. For any damage caused to asphalt or concrete driveway at the scene of the move, unless the customer has clearly forbidden the carrier to place its vehicle at that place.

Client involvement in the handling

It is understood that the objects to be transported must be loaded and unloaded by employees of the carrier. If other people are involved in this work, the carrier will therefore be released from any liability to the client.

Articles of extraordinary value

The carrier is not bound to carry any documents, specie or any articles of extraordinary value, unless an agreement has been concluded to this effect. If such goods are carried without a special agreement and the nature of the goods is not disclosed hereon, the carrier's liability for loss or damage cannot be recognized.

Payment

The trucker will not deliver the full load until all fees have been paid in cash or certified check. Payment by personal check is not allowed. If these conditions are not met, the carrier will have to hold the shipment until full payment. In case of non-payment, the customer will bear the cost of retention, such as transportation, warehousing and transhipment.

Delay

  1. The carrier is not responsible for any delay caused by an obstruction in any public way, by a defective or non-paved path, the insufficiency of any highway, bridge or ferry to support a transport vehicle or a failure or mechanical defect of the transport vehicle or its equipment;
  2. The carrier is not responsible for the delay in the execution of a move for a specified time;
  3. Failure to accept delivery when it is made within the prescribed time will make the recipient liable for charges of storage, handling and forwarding borne by the carrier.

Cancellation of contract

The carrier may cancel this contract:

  1. If he sees vermin, cockroaches or excessive filth at the scene of the move;
  2. If access to the place of removal is considered dangerous (eg if the stairs are covered with ice).

Goods not delivered

If, through no fault of the carrier, the goods cannot be delivered, the carrier shall immediately notify the shipper and recipient that delivery has not been made, and shall seek instructions on how to dispose of the goods.

While awaiting these instructions, the carrier may:

  1. Keep the goods in his warehouse, considering a reasonable storage fee;
  2. After notifying the sender and recipient of his intentions, move and store goods in a public or licensed warehouse at the expense of the sender, in which case it is no longer responsible for loading, while maintaining a hold in exchange for payment of all legitimate expenses of transportation and others, including a reasonable charge for storage.

Dangerous Goods

Anyone, directly or indirectly, shipping explosives or other dangerous goods without previous full disclosure to the carrier of the exact nature of the load in the manner prescribed by law or regulation, shall indemnify the carrier for loss, damage or delay that would result, and these items can be stored in a public warehouse at the expense and risk of the sender.
